PRIVACY NOTICE

I. Corporate Identity and Offices

 

Pursuant the provisions set forth on the Federal Law on Protection of Personal Data held by Private Parties (Ley Federal de Protección de Datos Personales en Posesión de los Particulares), its Regulation, and the Privacy Notice Guidelines (hereinafter referred to as the “Law”) Maroba Consultores, S.A. de C.V. (hereinafter referred to as the “Responsible One”) hereby makes its Privacy Notice (hereinafter referred to as the “Notice”) public, in order to make the terms and conditions of the personal data and sensitive personal data treatment public, that will be handled by the Responsible One. For the purpose of this Notice, the Responsible One has its offices at Insurgentes Sur 619-601, Colonia Nápoles, C.P. 03810, Mexico City.

 

II. Personal Data subject to Treatment and its Intended Purpose.

 

All personal information provided or made public by you to the Responsible One, will be used to fulfill the corporate purpose. Our customers information shall be required for the performance of our recruiting, selecting personnel, head hunting, and staffing services; administrating and outsourcing payroll services; tax, financial, managing, economic, corporate and legal advisory and consultancy services, and otherwise, to all sort of natural and legal persons, and furthermore, to any notice pertaining the performance of the services and the fulfillment of the purpose of the binding relationship that originated the personal data treatment. For all the aforementioned, we need the following personal data: full name (for natural persons); corporate or business name (for legal persons); articles of incorporation; address for tax and serving purposes; country of residence; sex (for natural persons); birth or incorporation date and place, as the case may be; legal representative full name and ID (for legal persons); power of attorney (for legal persons); email account; phone number; banking and financial data; tax identification registry at the SAT (Internal Revenue Service); CURP (Unique Population Register Code); Public Registry of Property and Commerce Sheet; 01 AFIL Format (Employers Registration and Modification Notice); and CLEM Format (Work-related risk insurance Notice). All the above shall be referred to as “Personal Data”, for this Notice purpose.

 

 

III. Sensitive Personal and Financial Data subject to Treatment and its Intended Purpose-

 

Pursuant the provisions set forth on the Law, we hereby inform that the Responsible One might gather the following sensitive personal and/or financial data: banking account numbers, banking and/or financial statements (hereinafter referred to as “Sensitive Personal Data”). The aforementioned Sensitive Personal Data will be gathered in order to pay for the performance of services or invoice purposes, for the following rendered services: recruiting, selecting personnel, head hunting, and staffing services; administrating and outsourcing payroll services; tax, financial, managing, economic, corporate and legal advisory and consultancy services, and otherwise, to all sort of natural and legal persons, among others. All Sensitive Personal Data gathered herein, shall be treated under the most strict security measures, warrantying its confidentiality

 

Pursuant Section 9 of the Law, a written consent shall be required for the Sensitive Personal Data treatment, so please mark the answer:

“____ I authorize that my Sensitive Personal Data shall be treated according to the terms and conditions set forth herein.” Name and signature of the data owner.

“_____ I do not authorize that my Sensitive Personal Data shall be treated according to the terms and conditions set forth herein.” Name and signature of the data owner.

 

 

IV. Means for gathering Personal and Sensitive Personal Data.

 

 

The hereinbefore Personal and Sensitive Personal Data shall allow the Responsible One to fulfill its technological, administrative, tax, civil, and/or commercial obligations. The aforementioned data shall be gathered: by email and phone communications with the Responsible One authorized personnel; voluntary and personal data supplied by interviews and mail means, through conversation interchange at the website www.maroba.com.mx; and by data provided at the Responsible One’s facilities, for identification purpose.

 

 

 

V. Transference and Intended Purpose.

 

The Personal and Sensitive Personal Data gathered by the Responsible One shall not be transferred to third parties, due to the nature of the treatment.

 

 

If transfer is necessary, the Responsible One shall notify you the nature and the purpose of the transfer, as well as the third person who will receive the Personal and Sensitive Personal Data, in order to obtain a written consent, in the following terms:

 

“In order to fulfill its contractual, technological, administrative, tax, civil and/or commercial obligations, the Responsible One hereby states that your Personal Data will be transferred to [person(s) identity that will receive the information, other than affiliated or subsidiary companies] with the purpose of [intended purpose of the data transfer] provided that the third parties undertake to keep secret and confidential the delivered Personal Data and to fulfill the terms and conditions set forth herein.”

 

Pursuant Section 36 of the Law, a written consent shall be required, in order to transfer your Personal Data to third parties, so please mark the answer:

“____ I authorize the transfer of my Personal Data, according to the terms and conditions set forth herein”.

“_____ I do not authorize the transfer of my Personal Data”

 

Pursuant Section 37 of the Law, the Responsible One will not require a written consent to transfer the gathered Personal Data to its domestic or foreign affiliated and subsidiary companies, which share processes and internal policies, for their corporate management.

 

VI. Consent.

 

By reading this Notice, the owner of the Personal Data implicitly consents the use of it by the Responsible One, according to the terms set forth herein, unless you explicitly indicate your opposition, pursuant the procedure set forth hereunder.

 

VII. Means and Procedures to exercise the right to access, rectification, cancellation and opposition.

 

Please contact the Service Manager, who is the person in charge of the personal data protection, by email at informes@maroba.com.mx or by phone at 52 50 42 81, providing your name, address, and the purpose of your request, if you have any question regarding how the Responsible One processes the Personal Data, or if you like to access, rectify, suppress, copy, restrict or cancel the use of the Personal and/or Sensitive Personal Data, or eliminate it, or if you request the Responsible One to stop using your Personal and/or Sensitive Personal Data. Once the Service Manager receives your request, it will be analyzed, according to the provisions set forth on the Law, its Regulation, and the internal policies regarding privacy matters. The answer to your request will be delivered to you in three (3) working days, after the request is submitted, and the answer shall be duly substantiated and can be in an affirmative or negative way. According to the laws on protection of personal data and other regulations, certain Personal Data are exempt from its access, rectification, suppression, copy and elimination.

 

 

VIII. Withdrawal of Consent

 

 

Please contact the Service Manager, in case of withdrawal of the consent of your Personal and/or Sensitive Personal Data treatment, by email at informes@maroba.com.mx or by phone at 52 50 42 81, providing your name, address, and the purpose of your request.

Once the Service Manager receives your request, it will be analyzed, according to the provisions set forth on the Law, its Regulation, and the internal policies regarding privacy matters. The answer to your request will be delivered to you in five (5) working days, after the request is submitted, and the answer shall be duly substantiated and can be in an affirmative or negative way.

 

 

 

IX. Personal Data Department

 

 

The Responsible One shall take the proper measures, in order to protect the Personal and Sensitive Personal Data, according to the provisions set forth on the laws on data safety and privacy, including administrative, technical, and physical security measures. Furthermore, the Responsible One can force the third parties related to it in terms of this Notice, to take proper measures to protect the Personal and Sensitive Personal Data. We hereby inform that the security measures taken according to the provisions set forth herein are the same security measures taken by the Responsible One, regarding its own information, which is construed as confidential, due to the nature of the services performed by the Responsible One. For any question pertaining your Personal and/or Sensitive Personal Data protection, please contact the Service Manager and person in charge of that matter at: Insurgentes Sur, 619-601, Colonia Nápoles, C.P. 03810, Mexico City, or by email at informes@maroba.com.mx or by phone at 52 50 42 81. Any communication with the Service Manager shall have an acknowledgment of receipt by email to the account provided as part of your information. Otherwise, shall be construed as no existing.

 

 

X. Means and Procedures for Privacy Note Amendments

 

The Responsible One can modify this Notice, in order to improve it or to incorporate new measures set forth on the Law and regulations. Any modification shall be notified at the latest five (5) working days, after the new privacy notice is implemented, at our website www.maroba.com.mx, integrating the updated privacy notice.
